Dear Comrade,

 

            We place hereunder the formulations made on behalf of the Staff Side, National Council JCM for effecting changes/amendment to the various recommendations made by the 6th CPC.  Copy of the letter, the Staff Side Secretary has sent to the Cabinet Secretary, is also appended hereunder.  This need not be taken exhaustive.  The meeting of the Staff Side, Standing Committee is slated to be held on 25th April, 2008. The issue will come up for discussion in that meeting.  Since the National Executive of he Confederation is scheduled to meet only on 27th it is necessary that we get your views and suggestion in the matter to be placed in the Standing Committee meting immediately and in any case before 20th April, 2008.  Kindly use the Confederation e mail id i.e. confederation06@yahoo.co.in for this purpose. Whatever changes are required to be proposed shall be finalized by the CHQ Sectt. Of the Confederation on the basis of this feed back.  We also request the affiliates to finalise the department specific issues and anomalies to place it before the proposes anomaly committee for a quick and time bound decision..

Copy of Staff Side Secretary letter dated 8th April, 2008 in NC/JCM-2008/VI CPC (CS) addressed to the Cabinet Secretary.

 

Dear Sir,

 

As you are aware that the report of the VI CPC has been submitted and there are varied types of commentaries including expression of anger amongst the Central Govt. employees in various parts of the country.

 

We, Staff sie members of the National Council JCM have discussed and prepared a Note which we are enclosing herewith.

 

We will like to request you to kindly advise Secretary (DOPT) who is also the Chairman of the Standing Committee (NC-JCM) to call the meeting of the Standing Committee to discuss al these matters in presence of Secretary (Expenditure) and orders concerned.

 

I have met the Secretary (Expenditure) who has kindly clarified certain issues. This has gone a long way in proper understanding of the issues involved.

 

An early action would help clear the atmosphere.

The modification required to be made to the report of the 6th CPC

 

1.       A.The minimum wage

The computation of minimum wage of the 6th CPC is not acceptable for the following reasons in brief.

 

i.                    Prices applied for various commodities (included in the basket) is the wholesale price as increased by 20% which is not the norms prescribed by the 15 IL

ii.                   The exclusion of 25% for meeting expenditure connected with social obligation like marriage, education of children, recreational needs etc. is on the untenable grounds.

iii.                 The exclusion of 10% for the housing requirement (on the ground that HRA is given separately) is not correct as HRA is not a full reimbursement of the expenses incurred by the employee.

If these corrections are carried out the need based minimum wage will be what is computed by the staff side.

 

B. Even as per the formulation adopted by the 5th CPC the minimum wage works out to Rs.7400 i.e. by application of the percentage increase of the net national product which comes to 56.2%

 

C. The Commission, without assigning any reason has rejected the demand of the staff side for parity in the minimum wage with what is obtaining in certain specified public sector undertakings.

 

D. For the above reasons, the minimum wage need to be worked out afresh and the same reflected in all the pay bands appropriately by applying the resultant multiplification factor as was done by the 5th CPC.

 

2.                  Fitment formula

Rejection of point to point fixation, (which is normally adopted by the PSUs in their wage revisions as fitment formula) is for no sound reasons. There is no 40% hike as propagated by the Commission..  By withdrawing the benefit of merger of DA the actual rise is between 15 to 28% . Our demand in this connection is as under:-

 

(a)    The merged portion of the DA should be taken into account to arrive at the revised basic pay and Grade Pay in each case.

(b)    Since quite a number of pay scales have been merged together (especially in Gr.B & C cadres)the senior employees who were in higher scales of pay and who have put in large number of years of service progressively get reduced benefits.

(c)    Taking these two factors into account we suggest that the fitment formula as suggested by the Commission may be amended to incorporate the following:

 

" subject to the condition that the pay and grade pay so fixed is not less than 2.625 times of the pre revised basic pay."

 

`                                   The multiplication factor of 2.625 is the same as is applied in the case of the entry grade pay band and grade pay in the case of Gr.A officers. This clause will make good the loss of benefit one might suffer due to the exclusion of the DP from the computation process of fitment formula. 

               3.            Rate of increment.

 

                  (a)              The rate of increment suggested by the CPC is to be raised to 3.5% for the following reasons:

 

(i)         The 2.5% is below the existing rate of increment in many grades.

(ii)        Due to the compounding factor, over a period of ten years, this might rise to 4.5% still less than the prevailing rate of increment in the PSUs which is 5% and above.

 

(b)                            The condition prescribed i.e. to have a minimum six months for applying the uniform date of increment must be done away with, as it is only to be applied in the initial year. 

 

4.         Transport allowance.

The recommendation of the Commission is to subsume the CCA in the Transport allowance and raise the existing Transport allowance by 4 times.  This has  reduced the proportionate benefit to certain grades and categories of employees.  We make the following suggestions:

(a) Since the CCA has been subsumed in this allowance, no condition should be imposed for the grant of this allowance.

(b) Taking into account that some of the employees might get reduced benefit from the across the board rise at the rate of 4 times, the following rates may be applied.

5. Fixation of pay on Promotion

 

In the present scheme of things, wherein many grades have been merged under one single Pay band, promotion will not bring about any significant rise in emoluments.  The benefit will be very insignificant in the case of promotion from one grade to another where the grade pay is one and the same.   In that case the one increment benefit will be less than even what is obtaining today.  We suggest to incorporate the following clause to take care of this situation.

 

"the pay plus grade pay so fixed on promotion shall not be less than 10% of pay plus grade pay the individual was drawing in the feeder cadre."

 

6.            Allowances and benefits withdrawn.

 

Certain allowances and benefits have been withdrawn to be replaced with a new scheme. The New scheme will have to be formulated on the basis of discussion/agreement in the National/Departmental Council as the case may.  Till such agreement is reached, the old scheme of allowances and benefits will continue to be operated relating to the revised basic pay and grade pay.

 

7.                  Special duty allowance of North Eastern Region.

We hope that the SDA will now become available for all employees working in the North Eastern Region.  However, we feel that  it is likely that the phraseology  employed in detailing the scheme is capable of misinterpretation giving room for further discrimination amongst the employees posted in N.E. Region.  This may therefore, be appropriately clarified to mean that the employees and officers working in  North Eastern Region is entitled to draw this allowance .

 

8.      Daily allowance on tour:

           

            The rates of daily allowance which include the following elements, viz. food, conveyance and accommodation suggested by the Commission to the officers other than Gr. A is extremely meager and would not go to meet the expenditure involved.  We suggest the following amendment .

            The rates prescribed for grade pay of Rs. 4200 to 4800 and below Rs. 4200 may be replaced with the following.

 

Rs. 4200 to 4800

Reimbursement of hotel accommodation of upto

Rs. 1000 per day . reimbursement of travel charges

upto Rs. 150 per diem for travel within the city and

reimbursement of food  not exceeding Rs. 200 per day.

Below Rs. 4200

Reimbursement of hotel accommodation of upto

Rs. 700 per day . reimbursement of travel charges upto

Rs. 150 per diem for travel within the city and

reimbursement of food  not exceeding Rs. 200 per day.

           

 

           

 

 

 

 

 

 

 

 

9.      Promotion. ACP Scheme.

            The scheme should be improved to provide three promotion at the intervals of ten, twenty and twenty five years of service.

 

10.      Inappropriate rationalization

            There is a great deal of resentment over the rationalization of the scales of pay of S9 to S12. The grievances in this must be addressed by appropriate decisions.

 

11.                  Pension.

           

The Staff Side appreciates the acceptance of some of its suggestions for improving the pension of the old pensioners by the Commission. However, we feel the following amendment is needed in the case of pensioners.

 

(a)                      to raise the minimum pension from the suggested 50% to 75% i.e. from Rs. 3330 to Rs. 4995.

(b)                      The 5th CPC suggestion to refix the pension on the basis of the notional pay as on 1.1.1996 is to be implemented. The pension entitlement has to be worked out on that basis.  The new commutation table to be applied only prospectively.

                             (C) The restoration of commuted value of pension should be on completion of 12 years

 

 

 

12.               Fast track committee.

 

There are cases like the Master Craftsmen, where the existing pay scales have been reduced to a lower scale.  To consider these types of cases, a fast track committee may be set up.

 

13.               Anomalies.

 

There are certain anomalies arising from the disturbance of vertical and horizontal relativities etc.  For quick and time bound disposal of these anomalies a Joint Committee of the National Council JCM with the participation of the Secretaries of all concerned Ministries should be constituted.

 

14.               Grameen Dak Sewaks.

 

Grameen Dak Sewaks are employed by the Postal Department.  They constitute the largest segment of the workforce of the Postal organization. We suggest that the pay, allowance, pension and other benefits in their case should be proportionately what is suggested to the regular civilian employees.  Since the Group D Cadres have been abolished, they may be promoted/absorbed/regularized in Group C cadres in the same manner provided for matriculate/non matriculate regular Group D employees

Sub:Payment of Dearness Allowance to Gramin Dak Sewaks (GDS)-at revised rates from 01-01-2008-regarding

 

D.G. Posts No. 14-5/2007-PAP dated 03.04.08.

 

Consequent upon grant of another installment of Dearness Allowance to the Central Government employees with effect from 1.1.2008 vide Govt. of India, Ministry of Finance, Department of Expenditure, New Delhi O.M. No. 1(1)/2008-E-II(B) dated 17.3.2008, the Gramin Dak Sewaks have also become entitled to the payment  of Dearness Allowance at the revised rate w.e.f. 1.1.2008. It has, therefore, been decided that Dearness Allowance payable to the GDS shall be enhanced from the existing rate of 91% to 97% (Ninety Seven per cent) of Time Related Continuity Allowance with effect from 1.1.2008.

 

2.         The additional installment of Dearness Allowance payable under this order shall be paid in cash to all Gramin Dak Sewaks.

 

3.         The expenditure is debitable to the Head of Account 'Salaries' under the relevant Head and should be met from the sanctioned grant.

MEMBER [P] DIRECTION MODIFIED

Kindly refer to Member (Personnel)'s d.o letter No. 6-19/2007-SPB-II dated 07.12.2007 regarding posting of such persons as Postmaster in LSG delivery offices who have qualified in the Fast Track examination in the years 2003 and 2004.

 

It is gathered that the Circles have taken necessary action in the said direction. It is, however, understood that due to personal reasons some officials are not in position to move to the new place of posting/transfer immediately. It has been decided that the CPMsG may consider such requests received if any, and defer the transfer on purely temporary basis in most deserving cases only without losing sight of the purpose for which transfers have been ordered.

PAY COMMISSION ON GROUP D UPGRADATION

Dear Comrades! After submission of its recommendations, the Pay Commission has now clarified in its official web site that the upgradation of non-matriculate Group D to PB-1 scale should also be given effect to from 1.1.2006 after completion of training within 6 months. The extract of the Pay Commission is reproduced below:
 

Placement of Group D in PB-1

As mentioned in para 3.7.9(i) of the Report, all Group D employees possessing prescribed qualifications shall be placed in the PB-I pay band of Rs. 4860-20,200 along with grade pay of Rs. 1800 with effect from 1.1.2006. Other Group D employees not possessing prescribed qualifications shall be retrained and after retraining they shall also be placed in the PB-I pay band along with grade pay of Rs. 1800 with effect from 1.1.2006. Arrears shall be payable in both the cases with effect from 1.1.2006. Further, retraining should preferably be completed with in a short period, say 6 months also, so that fixation in pay band PB-I and payment arrears of salary is not unduly delayed.

INFORMAL MEETING ON PAY COMMISSION ISSUES

Dear Comrades! The NFPE is getting a very good feed back and response from our membership on various recommendations of the Pay Commission. I have tried to reply to each and every email from comrades to the maximum and some comments from members are also published in the web sites. I request that while every email will be replied by the Federation, it may not be sometimes possible to reply all individually. However the web site will contain information showing the nature of action being taken and the nature of developments taking place. Please follow the web site frequently to get updated.
 
On 4.4.2008 afternoon, on an invitation from the DDG [Estt] we met him in an informal meeting to discuss about the pay commission related issues. This is only an informal meeting and the details are supplied for your information and interaction - Secretary General.
 

INFORMAL MEETING WITH DDG [Estt]

 

Deputy Director General [Establishment] had invited the Staff Side representatives of NFPE and FNPO for an informal meeting on 4.4.2008 to discuss on issues relating to 6th CPC recommendations for Postal Officials. The ADG [Estt] and the Director [SR] also participated from the official side.

 

 

Comrades K.Ragavendran [SG NFPE]; K.V.Sridharan [GS P3]; Ishwar Singh Dabas [GS P4]; Giriraj Singh [GS R3]; P.Suresh [GS R4]; S.P.Mukherjee [GS Admn]; and P.Rajanayagam [GS Postal A/Cs] represented the NFPE.

 

The following issues prominently found highlighted among other issues in this informal discussion:

 

  1. End of Group D in Central Government Services and its effects; Fate of Promotional Avenue of GDS etc: This is a common issue for all CG Employees. Moreover we raised the question as to from which date [viz., either from 1.1.2006 or from a prospective date] the upgraded scale would be made available to the Group D who are not possessing Matriculation. We made it clear that all CG Employees including the Group D should get the benefit of pay revision from 1.1.2006 only and not from any other date. We expressed that any abolition of Group D or denying the promotional avenue of three lakhs of GDS to the upgraded Group D posts on seniority basis as at present would be a serious issue.

 

  1. TBOP/LSG Supervisors and all other officials to be supervised by them on the same pay band; its effects: It was emphasized that due to placing the TBOP / LSG Supervisors in the pay band of PB1, not only the TBOP / LSG get less benefit but also it creates an anomaly wherein all other officials supervised by the LSG and the Supervisors are placed in the same pay scale.

 

  1. Supervisory Allowances to Supervisors: We tried to elucidate whether the Department will come forward to reintroduce supervisory allowances for distinguishing supervisors with higher responsibilities?

 

  1. Neglect of System Administrators and Marketing Executives: The neglect by the Pay Commission of these sections was effectively pointed out and  remedy emphasized.

 

  1. Issues of MMS Staff: The Artisans and Chargehand are placed in the same scale.

 

  1. Issue of Sorters in Postal Accounts: This is a neglected cadre and this may be merged with the LDCs.

 

It was suggested by the DDG [Estt] that both NFPE and FNPO Federations may submit a Note in writing on all issues of anomaly with regard to Postal issues for the consideration of the Department. He told that there will be another meeting before the Department of Posts finalizes and sends its report to Finance Ministry.

 

We requested for improvement on the above issues and assured that a note will be submitted by us as sought for.

 

Dear Comrades, the Federation and the CHQ got some feed back from some comrades from different circles after reading our web sites. It is requested that concrete suggestions on the following may be sent to NFPE / respective CHQs through emails or other communications:

 

  1. What stand should be taken by us with regard to the upgradation of Group D as Group C in the scale of Pay Band 1? Please keep in mind that the minimum wages suggested by the pay commission is being disputed by the Staff Side JCM National Council and that therefore the minimum wages is a matter for bilateral negotiations with the Government. If the minimum wages are enhanced and that a further upgraded pay is offered for all Group D in the Department, then what should be our stand?

 

  1. Whether the upgradation is accepted by the department for all Group D including non-test category after training and granted the higher scale of Pay Band 1, should we accept it or still oppose it?

 

  1. There is the question of promotional avenue adversely affected if the upgraded posts are not opened to the GDS. This requires further consultations with the department, as still the study of the pay commission report by the department is not completed. The Department may agree to continue to promote the GDS against the vacancies of upgraded Group D scales as before because there is another promotional avenue to postmen   cadre also is now available to GDS.  The Postmen scale is still higher than the upgraded Group D scale now. Therefore what should be our position if these promotional avenues to GDS are agreed to be continued by the Department?

 

  1. What is the suggestion we can concretely place for TBOP / LSG who are placed in Pay Band 1? Will it be alright if we demand placing them in Pay Band 2 in the pre-revised scale of pay of 5000-7000 and elevating the BCR / HSG-II to 5500-9000 even though both will be technically in the same pay band 2 with identical Grade Pay? Actually this was the scale for TBOP and BCR in the Telecom Department for TBOP and BCR. If better suggestions are there within the framework of the recommended pay scales by the pay commission please suggest.

 

  1. The Pay commission has not given any recognition to the supervisory staff. Whether we can demand supervisory allowance for norm based LSG / HSG-II/ HSG-I to distinguish them from non-functional staff?

 

  1. In the absence of a recommendation by the pay commission for System Administrators / Marketing Executives, can we suggest for advance increments or Special Allowance to these staff as an interim measure and continue to press for a separate establishment for these categories in future?

 

  1. Any other suggestions on any other issue please communicate.

ORAL EVIDENCE BEFORE GDS COMMITTEE

 

A delegation consisting of Comrade K.Ragavendran [Secretary General NFPE] and General Secretaries of affiliated unions / associations Comrades K.V.Sridharan [P3], Ishwar Singh Dabas [P4], Giriraj Singh [R3], P.Suresh [R4], S.P.Mukherjee [Admn], P.Rajanayagam [Postal A/Cs] as well as Comrades S.S.Mahadevaiah [General Secretary GDS], D.N.Giri [CHQ President GDS] and the Circle Secretary Uttarakhand GDS tendered oral evidence before the GDS Committee headed by Shri. Nataraja Murti on 4.4.2008 forenoon. The evidence took more than two hours and all the issues submitted in the GDS memorandum by the NFPE and the GDS Union were highlighted before the Committee.

 

The Departmentalisation of GDS; the method for Departmentalisation; Ensuring two career progression in GDS Service; protection of promotion to Group D on seniority basis even if the Group D posts are upgraded to Group C as per VI CPC recommendations; the issues of Social Security including Pension, Gratuity as per Gratuity Act 1972; enhancement of Group Insurance quantum to 1,50,000/-; Introduction of a system for Medical treatment; Changing the entire GDS Conduct and Recruitment Rules to end the discrimination in conduct and disciplinary matters between the GDS and the regular employees in line with the Supreme Court Judgment as well as making these rules statutory one; Facility for transfer to a vacant post; Free Insurance covering accident, natural calamity etc; Rationalization of leave with the facility to carry forward unutilized leave; Grant of 180 Days of Maternity leave for women GDS and special disability leave; Protection of wages by application of foot beat formula; Grant of Advances like Fan, Festival, Moped, HBA etc; Facilitating formation of cooperative societies for GDS; Full implementation of orders for conversion of GDS Mailmen in RMS larger platformed railway stations as Group D; Supply of uniforms to RMS GDS and outdoor GDS; Construction of work standards for GDS in RMS or straightaway departmentalizing RMS GDS as Group D since they work for 5 hours and more; Ending the discrimination between the RMS and Postal GDS to ensure RMS GDS also can become Mailguard through seniority basis in ½ vacancies like Postal GDS becoming Postman and various other issues were highlighted by the delegation.

 

The Chairman and the Member Secretary and other officials of GDS Committee had an interaction on many issues with us and even the Chairman Shri Nataraja Murti expressed that his endeavour would be to do as much good to GDS when we requested him to recommend a very positive report to the Government.

The Committee set up by the Secretary Department of Posts to look into the issues arising out of Pay Commission's Report headed by the DDG [Estt] has invited the Staff Side for discussion on 4.4.2008. We would like to request the Committee to treat this as a preliminary discussion to enable us to come again with  our concrete proposals. Any way Comrades are requested to send in their feed back if any to the Federation and respective CHQs through email or comments to blog or through SMS etc.

NFPE DELEGATION MET SECRETARY [P]

Dear Comrades! A delegation of NFPE consisting of its Secretary General and the General Secretaries of P3, P4, R3, Admn and Postal Accounts met Shri.I.M.G.Khan, the Secretary Department of Posts informally  on 1.4.2008. The Delegation thanked the Secretary [P] for granting the recognition to the Federation. The issues  raised and the response of the DG Posts are as follows:

 

1.      Reconstitution of Postal Departmental Council JCM in the wake of recognition to Federations and holding of Periodical Meeting with the Federation and All India Unions:

 

Secretary [P] agreed to the above.

 

2.      Anomaly in pay for TBOP and injustice to System Administrators etc:

 

We pointed out that consequent on placing the TBOP / LSG Supervisors in the same PB-1 pay band along with Sorters, LDCs, Postmen, PA/SA and some of these cadres who are to be supervised by the LSG also reaching the same Grade Pay of the Supervisor, the LSG /TBOP are much downgraded. The issue of Pay Commission neglecting the services of System Administrators also was pointed out. The DG mentioned that a Committee has been constituted in the Directorate to look into the issues arising out of Pay Commission's Report and suggested that the Staff Side can communicate such issues to the Committee after mutual consultations amongst the staff side.

 

3.      Promotions to JAO qualified Hands.

 

We tried to find out whether any progress had been achieved in the matter with the Department of Telecommunications. It was told that the Honourable Minister of State for Communications & IT with both the Secretaries is beckoning a meeting and the issue might be sorted out there. However he assured that if necessary pending a final decision on the matter of merger, the qualified JAOs might be given promotion adhoc / temporary basis and therefore on this issue we may prefer a discussion  with the Member [P].

 

4.      Modification of Member [P] orders to post FTP officials as SPMs in Delivery offices.

 

Secretary [P] told us that this has been done. Later the modified order has been made available to us. The order is modified to the effect that those officials who have genuine problems in getting disturbed from their present posts could be permitted to stay on etc. [Now affected officials should be guided to submit representations citing their difficulties and the latest DG instructions and get the transfer orders cancelled]

 

5.      Non-grant of notional promotions to LSG in Orissa circle.

 

The attempt to convene the DPC to fill up the posts of HSG-II without sorting out the notional promotions in Orissa Circle was raised by us. Secretary [P] assured that the Director would  shortly pay a visit to Orissa to sort out the issue.

6.      Attempt to form Mumbai City Region.

 

Secretary [P] categorically stated that no such proposal had been cleared by the Honourable Minister and the Directorate and therefore no new region could be formed as such.

 

7.      Atrocities of SSP Meerut Division.

 

Secretary [P] assured that necessary action would be taken.

 

8.      Changing the nomenclature of RMS in Kerala.

 

We pointed out the change of nomenclature of RMS in Kerala Circle while the issue is being discussed at the all India level between the official and staff sides. The Secretary [P] assured us that he would sort it as he is going to Kerala soon.

 

9.      Exemption of Screening Committee.

 

Secretary [P] informed us that a meeting of Secretaries was held and a decision with regard to those departments where already 10% establishment had been downsized, stopping further application of Screening Committee is likely to be accepted soon.

 

10.  Curtailment of Delivery by Circle Administration.

 

The curtailment of delivery resorted in places like Lucknow GPO, Patna GPO etc was brought to his notice and Secretary [P] immediately issued strong instructions for restoration at least 2 deliveries.

 

 

 

ORAL EVIDENCE BEFORE GDS COMMITTEE

 

On 4.4.2008, NFPE and GDS Union will jointly tender oral evidence before the Nataraja Murti GDS Committee on the issues of three lakhs of Gramin Dak Sevaks. The Delegation would consist of the Secretary General NFPE, General Secretaries P3, P4, R4 and GDS. In the background of 6th Central Pay Commission already submitted its recommendations, our delegation would place the issues of GDS before the Committee in a comprehensive manner.
