LTC ORDERS INCREASED OFFER TO NEW RECRUITS

Date of Effect is 1.9.2008.

Fresh Recruits will for the first 8 years service be given 3 Home Town and 1 All India LTC during a bloc year period.

Parents and Step Parents are now included in the Family of a Government Employee for the purpose of LTC.

Travel entitlements will be the same for both official tour and LTC.

Travel entitlements altered to allow AC 3 Tier to officials below 4200 Grade Pay; AC 2 Tier for 4200/4600/4800 Grade Pay; Economy Class by Air / AC 2 Tier for Grade Pay 5400 and 6500 and so on.

Total 60 days leave encashment permissible for LTC during entire career @ 10 days per LTC that will not be deducted from the EL at credit for encashment at the time of retirement.

TRAVELLING ALLOWANCE

Date of Effect is 1.9.2008.

The mileage earned by air travel by a Government Officer will here after words be used only for official tour of other officers.

Daily Allowance on Tour discriminates between official to official. While Hotel Room entitlement at varying level can be understood, the daily allowance for food is also different from one to another even though there is not going to be any change of price for food items in Hotels for person to person. The meaning is that while a lower grade official on tour with a higher official should eat less and less nourishment foods while his superior on tour can eat more nourishment.

CONVEYANCE ALLOWANCE

Date of Effect is 1.9.2008

Fixed Conveyance Allowance rates revised and when DA crosses 50% in the revised Pay Structure, then 25% should be added to the rates also.

CARETAKING ALLOWANCE

Date of Effect is 1.9.2008

10% of Revised Pay and Grade Pay will be paid.

Posts of Caretakers shall be merged with the general Ministerial Cadres in all Departments.

FAMILY PLANNING ALLOWANCE

Date of Effect 1.9.2008.

Family Planning Allowance doubled subject to a minimum of 210/= per month.

Grade Pay 1300 to 2400 = 210/=

Grade Pay 2800 = 250/=

Grade Pay 4200 = 400/=

Grade Pay 4600 = 450/=

Grade Pay 4800 = 500/=

Grade Pay 5400 = 550/= and so on.

SUCCESSFUL FEDERAL EXECUTIVE MEETING

NFPE FEDERAL EXECUTIVE SUCCESSFULLY HELD IN THIRUVANANTHAPURAM
 
 
ACP SCHEME ACCEPTED BY THE EXECUTIVE
 
 
Dear Comrades,
 
The Federal Executive of NFPE held its two days session on 22.09.2008 and 23.09.2008 in P&T House, Thiruvananthapuram [Kerala]. Many decisions were taken in the Executive. A detailed Circular will be released shortlY by the Federation. Major decision taken with regard to ACP and Cadre Restructuring is flashed hereunder:
 
1. Unanimously decided to give  letter to the Department of Posts immediately from the Staff Side accepting the ACP Scheme of financial upgradation in place of TBOP/BCR.
 
2. All Affiliated Unions / Associations of NFPE will finalise as like P3 CHQ a detailed Scheme of Cadre Restructuring for their respective cadres and give it to NFPE and the Federation would consolidate the same and submit to the Department of Posts. The Scheme finalised by P3 CHQ would be endorsed by the Federation to the Department of Posts for processing.

ONTO OUR 3rd FEDERAL EXECUTIVE MEETING AT THIRUVANANTHAPURAM

22-23rd September 2008

 

 
Dear Comrades!

 

We are going into our 3rd Federal Executive Meeting at Thiruvananthapuram in Kerala within a year since the 7th Federal Council Session held in Kolkata in October 2007.

 

Both the earlier Federal Executive Committee meetings were held in New Delhi. Due to developments that warrant our frequent meeting of Federal Executive, we are quickly going into our third session after the December 2007 and April 2008 Sessions.

 

The first meeting in December was to chalk out the strategy if pay commission recommendations are negative. The second meeting was in the background of submission of recommendations by the 6th CPC to the Government and our exercises over seeking modifications with regard to both common demands and sectional issues.

 

As you all comrades know very well, this third Federal Executive is entrusted with the task of taking important decisions in the immediate aftermath of implementation of pay commission recommendations. The Confederation of Central Government Employees in its National Executive analysed the whole situation and as all basic issues are rejected by the Government, unanimously decided to go for an Indefinite Strike after adequate preparations including Departmental level All India Conventions and strike ballot. This 3rd Federal Executive will deliberate on that in order to endorse the decisions of Confederation.

 

The much delayed Formal Meeting between the Department of Posts and Postal Staff Side has been completed on 16.09.2008 and we know the reactions of the Department on our sectional issues. In the background of the formal meeting now it is our task to deliberate and finalise our stand on Modified ACP Scheme; Finalise the detailed proposals on Cadre Restructuring to better our promotional avenues and to over come the age old problem of TBOP/LSG lower scales etc; Consider the delay in submission of GDS Committee Report and our counter action; Consider the reaction of the Department towards PO&RMS Accountants, System Administrators, Marketing Executives, MMS staff and other issues. Indeed this is a very important Executive.

It is hereby notified that in accordance with Article 12 of the Constitution of NFPE the meeting of the Federal Executive of the National Federation of Postal Employees shall be held in the P&T House, Near GPO, Thiruvananthapuram [Kerala] PIN: 695001 on 22.09.2008 and 23.09.2008 for considering the following agenda. SOME QUESTIONS ABOUT ACP AND FIXATION PAY
 
 
 Dear Comrades!
 
Some questions about fixation of TBOP/BCR Postmen Pay and the usefulness of ACP Scheme for the Promotees have come before us and as we are going to discuss in the ensuing 22nd September Federal Executive Meeting. Therefore comrades, particularly from P4 and R4 including Adminstrative Union, are requested to interact with their General Secretaries after analysing the following points:
 
  1. Some DDOs do not fix correctly the upgraded Grade Pay to TBOP Postmen and BCR Postmen. They say clear directions or instructions have not come from Directorate. Similarly in some places the upgraded PB-1 is not given to the Matriculate Group D and higher Grade Pay for TBOP and BCR Group D [Matriculates] also not given. What is the reason?

 

  1. Whether ACP Scheme has been ordered by the Department of Posts? Whether we will get upgradation of pay in accordance with 3 ACP Scheme immediately?

 

  1. Whether the ACP Scheme is beneficial to Promotee Postmen and Promotee PA/SA? If yes how and if No why?

 

ANSWERS:

 

  • Many DDOs in different Circles have correctly fixed the higher Grade Pay for TBOP and BCR level of Postmen without any problem. We learn that whose Circles which have used the Pay Fixation Software supplied by Mysore PTC have done the fixation more or less correctly. Even in many other Circles there is no problem with the fixation. Only in some circles the DDOs are taking a position that without a clear direction from the Directorate to fix on the exact higher Grade Pay for TBOP and BCR level officials, they won't fix it in higher level. Anyway the Federation and the P4 CHQ took up the matter with the Directorate and also in the formal meeting on 16th September 2008 with the Member [P]. But the Department has taken a position that this instruction or direction would  be issued only after our accepting or rejecting the ACP Scheme so that they can instruct to fix it either according to ACP basis or TBOP/BCR basis. Therefore it will take some more time because NFPE can accept or reject the ACP Scheme only after the matter has been discussed in the 22nd September Federal executive meeting at Thiruvananthapuram. On our writing to Department about our accepting or rejecting the ACP Scheme, the Directorate has assured to release clear instructions in this regard.

 

  • ACP Scheme has been modified by the Pay Commission and further modified / improved by the Government. But order from DOPT about the modified structure of ACP is yet to be notified. Even though we have discussed the issue with the Department of Posts on 16.09.2008 and that the Department also has agreed to implement the ACP Scheme for postal employees on our acceptance, the Staff Side has not given its consent letter for agreeing ACP Scheme instead of TBOP/BCR Scheme so far. We will give such a letter only after the issue is discussed in the ensuing Federal Executive Meeting in Thiruvananthapuram on 22.09.2008. However the ACP Scheme will be implemented only after the Government issuing new Modified ACP Scheme orders and the Department issuing another order for implementing it to the employees of Postal Department. This may take some more time.
  •  
  • As per the modified 3 ACP Scheme, after completion of 30 years of service, the direct recruit PA/SA will reach upto 4600/= Grade Pay; Direct Recruit Postmen will reach up to 4200/= Grade Pay; and the upgraded Group D will reach up to 2400/= Grade Pay. However Promotee officials cannot reach up to the same level. This is because the promotion from one cadre to the other by passing the examination or by seniority is considered as one upgradation already obtained in the service of the official. Therefore out of total 3 ACP upgradations, only the remaining upgradations will be given . For example if a Postman has passed examination and has become a PA, then he is eligible for only two more ACPs and not 3 ACPS. Therefore he cannot go to 4600/= Grade Pay level but only up to 4200/= Grade Pay level on completion of 30 years of service. If a Group D has become Postman and then a PA then he is eligible for only one more ACP in his service on completion of 30 years of service, which means he will reach only 2800/=Grade Pay level. This is the negative effect in comparison to our TBOP/BCR Scheme. However TBOP is after 16 years of service and BCR after 26 years of service and there is no third level in this Scheme. But ACP is after 10 years of service and then 20 years of service and also on 30 years of service. This is the difference.
  •  
  • However you can see that a Postman who remains in the same cadre of Postman through out his service will reach 4200/= Grade Pay on completion of 30 years of service. At the same time a Postman promoted as Postal Assistant also will reach the Tsame 4200/= Grade Pay on completion of his 30 years of total service. No difference at all.
  •  
  • In rare cases, a GDS who had become Group D after 10 years of service, and then became a Postman may not have 30 years of regular total service before his retirement. Such officials may not be able to get the 3rd ACP at all.
  •  
  • The negative aspect of ACP against the Promotee officials can be offset only through 'CADRE RESTRUCTURING SCHEME" which is nothing but a 'New Promotional Scheme' under which without such restrictions to move up in the ladder of promotion, Promotee Officials also can move up to reach the level of 3rd ACP available to Direct Recruits under ACP Scheme. Therefore the Staff Side is seriously working on a Cadre Restructuring Scheme even though no Cadre Restructuring Scheme will be possible without matching savings under the DOPT Guidelines on this matter.

 

All are free to comment on this matter. But one basic thing all should not forget is that there cannot be any condition in accepting the ACP. Because it is simply a matter of accept it if you like or reject it if you don't like it, is the reaction of the Government. Any suggestion for improving the ACP might be taken up with the Government through the National Council JCM Forum in future; but cannot be linked with any condition immediately. This is the situation at present.

 CELEBRATE CENTENARY OF CALCUTTA POSTAL CLUB

 
BABU TARAPADA MUKHERJEE - FATHER OF P&T TRADE UNION MOVEMENT ESTABLISHED THE GENESIS OF THE FIRST TRADE UNION IN P&T IN 1908 BRAVING THE TYRANNY OF BRITISH RULE.
 
Dear Comrades!
 
One Hundred Years has gone by since the establishment of 'Calcutta Postal Club' - the genesis of the first trade union organisation in disguise - and let us celebrate the big event on 20th September 2008.
 
It was the days of colonialism and tyranny of British Imperialism. Trade Union was considered as a capital crime against the Royal Rule. No one could even dream about democratic or trade union rights in that time. Even submission of Memorandum or Supplication has to begin with the prayer of permission for submitting a Memorandum! No Attendance timing; No time factors; No dependable gradation lists; No question of consultations with staff representatives; No trade union rights including right to form a trade union organisation!
 
Comrade Babu Tarapada Mukherjee - the great personality acclaimed by one and all as the Father of P&T Trade Union Movement - who got the courage and vision and wisdom to establish 'CALCUTTA POSTAL CLUB' - a platform fecilitating employees to assemble in a place in the name of recreation club - and use it very cleverly for infusing working class consciousness and trade unionism as early as in 1908, is to be rememberd today by one and all.
 
Every big trea has a small beginning. Without that beginning no big organisatin could however emerge out from the sheath of the seed. The 'CALCUTTA POSTAL CLUB' was the seed - the beginning - the emerging out of the total darkness - that gave rise to the historical and militant first All India basedTrade Union of the Postal Workers "The All India Post office and RMS union' in 1921.  The first All India Conference that was held in Lahore witnessed the historic presidential speech of Comrade Babu Tarapada who thundered that 'Workers are not Beggers'.
 
NFPE calls upon all our Affiliated Organisations at all levels - to celebrate the great event of establishment of 'CALCUTTA POSTAL CLUB' on 20.09.2008. NFPE is glad to announce that our West Bengal Circle Unions are organising Statewide celebrations to commemorate the historic event. NFPE is the offspring of that militant class conscious movement originated from 'Calcutta Postal Club' - Let us look back with pride that our movement has crossed one hundred years of glory and unrelenting struggles in defence of the interests of Postal Workers.
 
Let us get rejuvenated by the centenary celebrations to carry forward our battle against the attacks of neo-liberal economic policies and globalisation that once again try to impose the similar conditions of existence that existed 100 years back in 1908.

20 POINT OF CHARTER OF DEMANDS FOR 19th SEPTEMBER 2008 CONFEDERATION PROGRAMME

Charter of demands

 

1.     Grant Rs. 10000/= as minimum wage as per 15 ILC Norms.

 

2.     Grant minimum fitment benefit of 2.625 times of pre-revised basic pay to bring about uniform rise in emoluments and raise grade pay to 50% of the maximum of the  pre-revised scales in respect of PB 1,2 & 3 as has been done in the case of PB 4.

 

3.     No abolition of Gr.D. Posts and functions.  Lift ban on recruitment, fill up all vacant posts and scrap screening Committee.

 

4.     Grant 10% of pay + Grade pay as minimum benefit on promotion or financial up gradation.

 

5.     No outsourcing or contractorising of Govt. functions.

 

6.     Fix the date of effect of all allowances as 1.1.2006.

 

7.     No reduction in the commutation value and restoration of full pension after 12 years.

 

8.     Grant statutory defined pension scheme to the employees recruited after 1.1.2004 and withdraw the PFRDA Bill from Parliament.

 

9.     Compute the pension entitlement on the basis of notional pay as on 1.1.1996.

 

10.  No performance related pay or bonus scheme.

 

11   Implement the Board of Arbitration Awards.

 

12. Remove the arbitrary 5% ceiling and 3 years condition on compassionate       appointment and withdraw court  cases and absorb all waitlisted RRR candidates.

 

13. Implement the revision of bonus ceiling @ 3500/- in the case of Govt.  Employees: Remove adhoc bonus and replace it with the PLB and remove the 60 days ceiling.

 

14. Grant SDA to all employees in NE Region.

 

15. Revise the Transport and daily allowances as demanded by the staff side JCM National Council.

 

16. Remove the condition of 6 months for applying the uniform date of 1st July as increment dates.

 

17. ACP to be on hierarchical system obtaining in each department.

 

18. Retain and improve CGHS and make insurance scheme optional.

 

19. Implement flexitime working hours for women/disabled employees as recommended by the 6 CPC.

 

20. Direct all the Departmental Heads to settle 6th CPC related department specific demands/problems within a stipulated time.

Sub: Anomalies arising out of implementation of pay commission recommendations – reg.

 

Dear Comrade,

 

The following issues require attention from the Staff Side for taking up with the Official Side for redressal and improvement.

 

1. Computation of Revised DA Formula:

 

While issuing orders for a revised DA Formula on accepting the recommendations of the 6th CPC, the Government ordered merger of 74% of DA as on 1.1.2006 with the basic pay by equating it with 536 Points in the All India Consumer Price Index for Industrial Workers [AICPI-IW]. This is wrong and only 533.01 Points should have been taken for merging 74% of DA. This wrong calculation of merger of 536 Points instead of 533.01 Points, the DA entitlement is only 12.94 instead of 13.53 and therefore after rounding off the figures the Government has sanctioned only 12% DA w.e.f. 1.1.2008. Actually it should have been 13% even after rounding off 13.53. Therefore on 1.7.2008 it should have been 17% instead of 16% granted. This is going to cause perennial loss to all the employees and a huge saving for the Government.

 

This distorted calculation is to be challenged by the Staff Side and corrected accordingly.

 

 2. Annual Increment:

 

It is observed that the Hindi and English version of Gazette Notification differ on the matter of Annual Increment. Hindi version says increments are to be granted on either 1st January or 1st July. The English version simply accepts the recommendation of Pay Commission for grant of increment uniformly for all on 1st July.  It was expected that the corrigendum would be forthcoming but nothing came about till now.  This may be taken up with the official side.

 

3. Grant of SDA to all employees in NE Region:

 

The Government Orders on SDA is still leaving room for confusion and various interpretations. Though the 'including initial appointment' is added in the order after discussion with the Staff Side, the definition of 'Area' is open for different interpretations yet and therefore the situation is not clear for payment of SDA to all employees in the NE Region. This requires to be taken up once again with the Official Side.

 

4. Heavy loss for Retired Group D employees:

 

The implementation of recommendations of pay commission to fix the pay of the non-matriculate Group D employees only in 1S Pay Scale with 1300/= Grade Pay until they are retrained and fitted in 1800/= Grade Pay in PB-1 may benefit the serving Group D only. Those non-matriculate Group D who are already retired after 1.1.2006 and before 31st August 2008 and also before the completing of the training programme yet to be worked out by respective departments will stand to lose very heavily including very much reduced pension. An exception to such cases to the effect that those who are already retired may be considered as trained or exempted from such training to facilitate fixing them in PB-1 with Grade Pay of 1800/= shall be taken up with the Official Side immediately to avoid heavy loss to such employees.

 

5. Matriculate Temporary Status Casual Labourers:

 

The DOPT has issued orders for fixation in 1-S Pay Scale with 1300/= Grade Pay for all Temporary Status Casual Labourers. This is against the existing order of the Government that all Temporary Status Casual Labourers will be placed on par at the minimum of the Group D because there are many matriculate passed Temporary Status Casual Labourers who are now fitted in 1-S Scale of Pay instead of PB-1 with 1800/= Grade Pay. This may be taken up for improvement.

 

6. Disparity between existing and direct recruits:

 

The Entry Pay in the revised pay structure for direct recruits appointed on or after 1.1.2006 is placed at a higher quantum in many cases. While we welcome any higher fixation for the direct recruits in any cadre, we feel that this should not create a condition wherein the senior employees in the same cadre are placed at a lower level of pay than the junior direct recruits. This anomaly has to set right in an appropriate manner.  

 

These issues may kindly be taken up with the Government.

CONFEDERATION REACTION

 

The above issues were discussed with the Confederation leaders in an informal meeting of the Secretariat of Confederation. The Item Number 2 to 6 would be taken up either directly or as anomalies with the Official Side by the Confederation.

 

With regards to Item Number 1, the following situation emerged out of deep discussion and calculations of the DA 2001 base year conversion formula and further computation of 12 monthly average of Cost of living Index:

 

As on 1.1.2006 the actual figures of DA was 74.79

We were drawing the round figure of 74% DA.

This 74.79 was converted into 2001 year base by Government.

The figure arrived at is 115.76.

Govt. rounded it to 115 and then calculated to arrive at the DA figures of 0% on 1.1.2006; 2% on 1.7.2006; 5% on 1.1.2007; 9% on 1.7.2006; 12% on 1.1.2008; and 16% on 1.7.2008.

Staff Side pointed out and objected to the rounding off of the fraction 0.79 out of 74.79 while conversion to 2001 base year.

Government corrected its position and not rounded it off and then recalculated to arrive at 0% on 1.1.2006; 2% on 1.7.2006; 6% on 1.1.2007; 9% on 1.7.2007; 12% on 1.1.2008; and 16% on 1.7.2008.

We checked the correctness of the Govt calculation and contrary to our earlier perception the recalculated figures of Govt are found to be accurate. No rounding off was made and usual carried forward of fraction continue to be done. The two mistakes were 5% instead of 6% on 1.1.2007; and 8% instead of 9% on 1.7.2007 due to rounding off while conversion which was later corrected by the Government. Therefore the DA conversion factor to 2001 base year is found to be correctly done by Government. We have no case in DA new base year 2001.

 

All other anomalies pointed out under Item Number 2 to 6 by NFPE as above will be taken up with the Government by the Confederation.
