The CHQs of All India Postal Employees Union Group C and the National Union of Postal Employees Group C have jointly issued a call for nationwide protest demonstrations and Savingram to the Honourable Minsiter of Communications & ITand to the Secretary [P] on 18.01.2008 and Dharna on 5.2.2008 to press the 20 Point Charer of Demands reflecting the sectional issues and certain urgent issues of Postal Group C employees. The joint circulars issued by the P3 CHQs of NFPE and FNPO are reproduced below for ready information.
 
The NFPE and FNPO jointly call upon all the affiliates of both Federations to extend total solidarity to the above programme of action by participating in full strength to make the struggle a resounding success.

Dear Comrades/Colleagues

 

The postal Group C employees are mounted under severe attacks one after another ignoring the sufferings we are having in Post Offices due to under staffing over six years. Adding salt to injury various new business activities without any norms, ethics or incentives are being launched. Our genuine demands are not properly taken care of.

 

The problems confronting us are multifying. On such vital issues like LSG, HSG II, HSG I promotions, the Circle Heads are lethargic and the department is unable to pull them to implement its own orders. There are more than ten thousand PA posts remains unfilled in many circles even after issue of orders simply by raising unwarranted clarifications. Even they are not attended by the Department and persuing them in a casual manner.

 

The Department on its own and without any talks or discussions is issuing various retrograde orders in the past like Declining LSG Promotion causes postponement of BCR, preventing second posting in same single handed Post offices, discrimination between regular and FTP LSG, sarcastic orders on the System Administrators etc. Our sincere, persistent endeavours to settle the issue have proved to be in fructuous.

 

We have been pushed to the wall to resist such onslaughts purported against the Group C employees. We have no other alternate except to launch series of agitational programmes against the wrong decisions, orders and lethargy in mitigating the agreed demands.

 

Therefore, we have decided to launch immediate following programmes with full determination for the Group C comrades who have been continuously exploited since 1999.

 

18.01.08 - Demonstration in front of all HOS/Divl offices/R.O/ Circle offices & sending Savigrams/Fax/ Postcard compaign.

 

05.02.08 - Dharna in front of D.O/R.O/C.O

Text Of The Savingram/ Fax/ Postcard Compaign

 

"Withdraw all unilateral and arbitary orders mentioned in the 20 point charter of demands immediately AAA. Settle all agreed demands placed in April 2007 strike AAA Ensure peace and amity and avoid further confrontation AAA."

The programme of action has been drawn based on the consultation of Federations which will endorse our call and further course of programme beginning with 'Non cooperation & Work to rule to indefinite strike will be decided with the consultations of Federations and other Unions.

 

It is therefore requested to that an impressive and effective Demonstration/ Dharna must be staged in front of the HO/D.O/R.O/C.O on 18.01.08 & 05.02.08 respectively and ensure maximum mobilisation. The task of campaigning, conducting the programme effectively and making it a success is the responsibility of the Circle/Divisional/Branch Secretaries and activists at the grass root level.

 

Let us prepare for the programme with seriousness and sincerity and stead fast efforts to ensure the programme a grand success to wrest the demands.

CHARTER OF DEMANDS

 

1.       Filling up of LSG, HSG II & HSG I Posts

 

(i)                   Recast the notional promotions since 1982/1983 onwards and fill up all vacant posts of LSG\, HSG II & HSG I.

 

(ii)                 Fill up 2/3rd unfilled LSG vacancies notionally from 7.2.02 to 18.5.06.

 

(iii)                Relax minimum qualifying service for HSG II promotion.

 

(iv)               Irregular application of bench mark of current period for notional promotions.

 

(v)                 Date of LSG Promotion be calculated from the date of issue of orders and not form the date of joining.

 

(vi)               Grant of Modification of LSG as one time measure for those aggrieved due to dearth of LSG vacancies/ Rule 38 transfers.

 

(vii)              Drawal of pay to senior BCR officials in HSG I posts as the pay scales of HSG II & BCR is one and the same & settlement of earlier officiating cases of Tamilnadu, West Bengal & other Circles as one time measure.

 

(viii)            Anomaly in the preparation of PA Gradation list. Date of confirmation should not be taken now and Date of appointment be taken for construing seniority. Fixing seniority based on the date of confirmation is unconstitutional and discriminatory.

 

2         Withdraw the draconian orders contained in Directorate letter No. 22-5/95-PE I dt 21.5.07 denying BCR benefits to those declining LSG Promotion. Several officials were arbitrarily, unjustified denied the due BCR promotion.

 

3         Filling up the APM Accounts LSG, HSG II posts as per 1976 LSG Accountant recruitment Rules.

 

4         Filling up Residual vacancies since 1999-2000 onwards without any further delay.

 

5         Immediate withdrawal of orders discriminating regular and FTP LSG and posting them in Delivery offices in the middle of the tenure.

 

6         Withdraw the Directorate letter dt. 22.10.07 on Systems Administrators and form uniform & correct norms & guidelines first before passing sarcastic comments.

 

7         Withdraw the orders fixing responsibility on D.D.Os/APM Accounts for the over payment of Pay & Allowances to Postman on account of Fixation under R.P. Rules.

 

8         Counting of special Allowance for pay fixation case of PO & RMS
Accountants.

 

9         Counting of Past services of erstwhile R.T.P for promotion & pension as per the Supreme Court direction.

 

10     Withdraw the condition in tenure posting of Single & Double handed offices & restriction in posting of SPM due to minor penalties/ CR entries which are in violation of provisions of statutory rules of volume IV.

 

11     Allowing all TBOP officials to appear for Group B exam to be held in Feb'08. as per original orders & various judicial pronouncements. The cut off date should be extended for the current exam as 01.01.2008. The exam should be conducted after completing the process of notional promotions to LSG in all circles.

 

12     Counting of Training period for increment and promotion to the departmental candidates also.

 

13     Revision of FSC to Post offices & Enhancement of honorarium for RD PMC work in Sub Offices, Department Exam invigilation work etc.

 

14     Implement the assurance made on 19.4.07 in fixing incentive to RPLI, IMT Pass port applications, NRGEIS, other business activities etc., Grant of OTA to operative staff to manage the shortage, Engagement of SDPA to manage the Shortage, Dispensation of Confirmation Exam etc.

 

15     Creation of Systems Manager/Administrators Posts & Marketing Executives. Grant of SPL pay and grant of Road mileage Allowance without restrictions. Trainers Allowance for imparting training Norms be fixed for Systems Administrators uniformly to all Circles; providing mobile phones, Fixing duties & responsibilities.

 

16     Allotment of adequate funds to clear all pending personal claims like OTA, TA medical etc. pending since 2002-03.

 

17     Spot payment of incentive to SPM/BPM for procuring RPLI business. Grant of incentive for schedule work in accounts branch.

 

18     Drawal of SB Allowances to all working in SB branches on computers.

 

19     Refund of Fee for appearing AMFI (Association of Mutual Fund industry) Exam to all candidates.

 

20     Revision of Bonus Formula & removal of 60 days cap.

On Charter of Demands

Regarding item 1(i) this should only be after preparing / recasting the Circle gradation list of T/S Postal Assistants as was in existence prior to 1982/1983 and settling discrepancies, if any.

Reg.item 1(ii) during the period the FTP Scheme was in force, 1/3rd only was open for promotion on seniority cum fitness.

Reg item 1(v) LSG being a norm based post it is felt that unless the promotion is ordered notionally as per the laws in force an official cannot claim this without actually taking charge of /joining the post to which he/she is promoted.

Reg. item (vi) The methodology in which this is to be modified is not clear. We have to give clear guidelines, I think, in order to avoid discrimination.

Reg. item 1(vii) Officiating arrangement once done in HSG I Post by whatever category of official is a matter of fact. Once held charge of a higher post, the official is entitled for the pay attached to the higher post as per FR & SR itself. There are many court verdicts confirming this also. Whether the arrangement is in order or irregular is a matter of administrative concern and is entirely an other aspect.

Reg. item 1 (viii) The said order has only prospective effect. As per G.I DoP&T O.M. No. 2001/5/90-Est.(D) dated 4-11-1992 this is effective only from 01-11-1992. Therefore, as was done earlier, a separate section for those recruited from 4-11-92 should be introduced in the gradation list. Two separate sections, one for those T/S Postal Assistants appointed between 22-06-49 and 21-12-59 (Seniority fixed according to length of service vide DG P&T letter No. 45 / 1 / 74- SPB –II dated 12-04-78) and another for those T/S Pas appointed on OR after 22-12-59 (Seniority fixed in accordance with D.G P&T No. 9/11/55 RDS dated 22-05-1959) in the gradation lists in force earlier ie. up to 01-07-1988.


Reg Para 2, it is not known as to how this is possible when Norm based promotion to LSG post is being given after a long period from the date of placement in Higher Scale of Pay under the BCR Scheme. The applicability of this instruction requires an explanation.

On Para 3, it is learnt that the Hon’ble CAT Chennai has delivered its judgement ordering to fill up all such posts vacant right from 1986. Implementation of this judgement is to be persuaded.

On para 5, it is felt that being a Norm based post this demand may not get the support of law. We can demand convening DPC for such norm based promotion against vacant posts and promotion order well in advance every year though it takes effect in the middle of year so that every body can plan.

Para 6: Such an order has not been communicated here.

Para7, In this connection what I have to comment is that this issue was due to certain clarifications / instruction received on fixation from department itself (as I feel) and hence attracts Para 11 of the Hon’ble Supreme Court order reported 1994 (2) SCC 521 Shyam Babu Verma and Others v. UoI & Others (reported in Swamys NewS Nov 2000 –Serial No.193- Page 83) wherein it was held by the Hon’ble Supreme court that although the petitioners were entitled for the reduced pay scale since the higher pay scale given was not due to no fault of theirs but only due to the fault of the petitioners (Here the Dept.) it shall only be just and proper not to recover any excess amount which has already been paid to them. While even the recipients are not responsible for repayment in such cases, there cannot be fixing of responsibilities on DDOs / APM Accounts.

Para 9 : In this regard it is to state that Four Ex-RTP officials were given full benefits by the Department on the strength of CAT Order while they denies this to others such officials. The order of the CAT Ernakulam in O.A No. 1410/95 dated 08-02-1996 was implemented in the case of only those FOUR applicants who went to the Hon’ble CAT as per Directorate letter No. 66-24/96-SPB-I dated 19-04-1996 a/t the CPMG, Kerala. These officials are enjoying the RTP service for Seniority, all Time Bound Promotions, Increment, Leave, Pension etc. This is nothing but arbitrary and clear discrimination and in violation of the Hon’ble Supreme Court order when the apex court themselves ordered that the benefits of a judgement should be extended to all those similarly/identically placed through various orders. Moreover the Department itself ordered regularisation of even irregular appointments without training (even pre training service on short term vacancies) earlier vide DG P&T ND letter No. 23 /5/ 68 –SPB.I dated 15-03-1974 suo moto. The observation of the Hon’ble SC in Dhirendra Chamoli and another vs.State of Uttar Pradesh case [ ATR 1986 SC 172 ] “It makes no difference whether they are appointed in sanctioned post OR not. So long as they are performing the same duties they must receive the same salary and Conditions of Service as regular employees” is very much relevant here. The word “Conditions” herein has its full meaning to read as all benefits available to regular employees on such service.

Hence, limiting the demands to regularise the RTP service “at least for pension” is quite inadequate especially when FOUR among such identical officials are enjoying all benefits as above.

Para 11, As long as the Placement as per TBOP Scheme is to “the next Higher Grade” (ie. LSG PA in r/o T/S PA) as contained in the original order on introduction of TBOP and the PSS Gr.B recruitment Rules 1994 is not amended (Those in LSG are eligible) in respect of T/S PAs, all those promoted under the so called TBOP so far are to be made as eligible to appear for Gr.B Exam without a cut off date 01-01-2008.
More over, LSG list as on 01-01-2003 (to find LSG officials with % years service) can be prepared only after finalising the Circle Gradation List of PAs in T/S Cadre right from 1982/83. The Madras Bench of the Hon’ble CAT

Para 12: The order counting Training period for the purpose of Pension, Promotion etc. in r/o outsiders is made applicable to only those on training as on 01-01-1986. Our demand in JCM earlier was to treat this for all in service then.( It was a case decided in JCM) This cut off date should be removed and the order to be made applicable to all those in service at the time of issue of that order.

The following New items may also be taken:

1: In view of the withdrawal of the FTP Scheme for LSG / HSG the earlier 1/3rd Exam should be resumed.

2: Entry to the IP / ASP /SP cadre from General line (T/S PAs / LSG /HSG ) on seniority (in r/o all ) / by exam (in r/o ASP) to be introduced.

3. Officials using Power Spectacles put on duties on Computers compulsorily should be given financial assistance to purchase progressive / antiglare lenses.

4: Grant of special Allowances to the System Administrators / Business Executives.

These officials are enjoying the RTP service for Seniority, all Time Bound Promotions, Increment, Leave, Pension etc. This is nothing but arbitrary and clear discrimination and in violation of the Hon’ble Supreme Court order when the apex court themselves ordered that the benefits of a judgement should be extended to all those similarly/identically placed through various orders. Moreover the Department itself ordered regularisation of even irregular appointments without training (even pre training service on short term vacancies) earlier vide DG P&T ND letter No. 23 /5/ 68 –SPB.I dated 15-03-1974 suo moto. The observation of the Hon’ble SC in Dhirendra Chamoli and another vs.State of Uttar Pradesh case [ ATR 1986 SC 172 ] “It makes no difference whether they are appointed in sanctioned post OR not. So long as they are performing the same duties they must receive the same salary and Conditions of Service as regular employees” is very much relevant here. The word “Conditions” herein has its full meaning to read as all benefits available to regular employees on such service.

Hence, limiting the demands to regularise the RTP service “at least for pension” is quite inadequate especially when FOUR among such identical officials are enjoying all benefits as above.

Para 11, As long as the Placement as per TBOP Scheme is to “the next Higher Grade” (ie. LSG PA in r/o T/S PA) as contained in the original order on introduction of TBOP and the PSS Gr.B recruitment Rules 1994 is not amended (Those in LSG are eligible) in respect of T/S PAs, all those promoted under the so called TBOP so far are to be made as eligible to appear for Gr.B Exam without a cut off date 01-01-2008.
More over, LSG list as on 01-01-2003 (to find LSG officials with % years service) can be prepared only after finalising the Circle Gradation List of PAs in T/S Cadre right from 1982/83. The Madras Bench of the Hon’ble CAT

Para 12: The order counting Training period for the purpose of Pension, Promotion etc. in r/o outsiders is made applicable to only those on training as on 01-01-1986. Our demand in JCM earlier was to treat this for all in service then.( It was a case decided in JCM) This cut off date should be removed and the order to be made applicable to all those in service at the time of issue of that order.

The following New items may also be taken:

1: In view of the withdrawal of the FTP Scheme for LSG / HSG the earlier 1/3rd Exam should be resumed.

2: Entry to the IP / ASP /SP cadre from General line (T/S PAs / LSG /HSG ) on seniority (in r/o all ) / by exam (in r/o ASP) to be introduced.

3. Officials using Power Spectacles put on duties on Computers compulsorily should be given financial assistance to purchase progressive / antiglare lenses.

4: Grant of special Allowances to the System Administrators / Business Executives.

sir
i have enterted in the RMS in the year 1982 as RTP .I have absorbed in the year 1988 as regular sorting assitant ,what about this six years RTP service,can i get any benifits for the above six years period.
