GDS COMMITTEE ONLY NEXT MONTH - MORE ISSUES HANDLED BY NFPE ON PAY COMMISSION

NATARAJA MURTHI COMMITTEE REPORT ONLY NEXT MONTH
 
SUBMISSION NOT LIKELY DURING SEPTEMBER
 
Dear Comrades - We were given the indication by an officer before the commencement of the formal meeting with the Member [P] today that the submission of Report by Nataraja Murthi GDS Committee will be only  next month. Therefore once again our comrades are requested to powerfully organise the demonstrations on 19th September 2008 demanding submission of Report without further delay. Do not forget to send SAVINGRAM to Secretary Department of Posts on that day. 
 
FIXATION OF HIGHER GRADE PAY TO TBOP/BCR POSTMEN
 
It has been raised in the formal meeting today with the Member [P] that the corresponding higher Grade  Pay to TBOP/BCR Postmen / Mailguard should be instructed to be paid by the Directorate, consequent on upgradation of Postmen / MG entry Pay Scales to 2000 Grade Pay level. The Department has taken a position that the same will be done only on the Staff Side giving in writing as to whether we want ACP Scheme or the existing scheme and on our giving such a letter the clarification would be expedited.  We can give letter only after our 22nd Federal Executive Meeting in Thiruvananthapuram. In the meanwhile we come to know that circles like Kerala where the pay fixation software supplied by the Mysore PTC is used the pay fixation to TBOP/BCR Postmen and all others faced no problem of any kind. The letter we have given to department is reproduced below at the end of this news bulletin.
 
SDA FOR NE REGION (INCLUDING SIKKIM) AND LADAKH
 
NFPE has given the following letter to the Secretary Department of Posts today demanding clarification on payment of SDA to NE Region (including Sikkim) and Ladakh requesting the Secretary to cause to issue instructions for payment to all. We are watching other Government Departments also for the stand being taken there. The letter is reproduced below at the end of this news bulltein.
 
PARA MEDICAL STAFF OF POSTAL DISPENSARIES
 
We raised in todays meeting and after that the letter of NFPE given to Secretary [P] with regard to the common category of para medical staff. The letter is reproduced at the end below.
 
TECHNICAL POSTAL ASSISTANT IN MMS
 
The issie of Diploma holding Technical Postal Assistant given a lower pay in MMS was pointed out in the meeting today. The Official Side pointed out that this cadre had been declared as a dying cadre and decided for merger with the PA/SA cadre. However we have  stated that even then their diploma qualification should be taken into account and higher pay should be granted to them. A letter given by NFPE to Secretary [P] at the end of today's meeting in this issue is reproduced below.
 
MERGER OF POSTAL DISPENSARIES WITH CGHS
 
As per the recommendations of the 6th Pay Commission, NFPE has today written to the Secretary Department of Posts to take initiative for merging the Postal Dispensaries with the CGHS and permiting postal pensioners to take treatment there. The letter written is reproduced below.

NFPE has already taken up the issue of calculation of pay as per the revised pay structure of corresponding cadres for RRR Candidates, Paid Substitutes and Part time casual etc. The letters addressed to Member [P] on this matter are reproduced below.

Sub: Re-fixation of wages of Paid Substitutes in tune with 6th CPC revised pay and allowances – reg.

 

Madam.

 

The Government orders on implementation of revised pay on 6th CPC recommendations have been issued. Therefore the wages being paid to Paid Substitutes engaged in leave vacancies of Postman and Group D also require to be suitable revised.

 

This Federation would like to  bring to your notice that while such re-fixation of wages for Paid Substitutes was ordered after the implementation of 5th CPC in 1997, the components of HRA / CCA were taken out of the computation in contravention of P&T Finance orders in existence at that time. Despite best efforts by the staff side the issue was not settled. But on the judgment of Honourable High Court of Madras the Directorate has ordered payment of wages for those paid substitutes who went to the court on the basis of correct computation of wages including elements of HRA/CCA. However the same is not extended to all similarly placed paid substitutes in other places.

 

Therefore this Federation would like to request that the following action may kindly be caused:

 

  1. Re-fixation of wages for Paid Substitutes on the basis of the revised 6th CPC pay; and
  2. Computation of refixation including components of HRA / Transport Allowance in tune with the spirit of the Honourable Madras High Court Orders.

 This Federation would highly appreciate an early action and a reply.

 

2. ON TBOP - BCR POSTMEN / MAILGUARD

Sub: Request for issue of instructions on revised pay for certain cadres like TBOP/BCR Postmen, DSV, Matriculate TBOP/BCR Group D  etc – reg.

 

Madam,

 

This Federation requests your personal intervention for the issue of instructions on the matter of revision of pay for the following categories of employees to avoid confusion and denial of proper fixation in the revised pay structure:

 

  1. The TBOP and BCR Postmen: Since the Postmen are awarded with upgraded pay scale of 3200-4900, the Postmen in TBOP and BCR level also are to be upgraded to next levels accordingly as otherwise many DDOs are likely to fix wrongly the Postmen, TBOP Postmen and BCR Postmen under the same Grade Pay level.

 

  1. The Departmental Stamp Vendors [DSV] who are of Postmen cadre also are to be fixed in 3200-4900 upgraded scale for which clear instructions from Directorate is necessary. This is requested from our past experience of V CPC when the DSVs were denied fixation on par with Postmen just because there was no mention in the first orders of the Directorate. Later on this was set right by subsequent orders only. This confusion is likely to occur this time also.

 

  1. The Group D scales are to be upgraded immediately for Matriculates. Their TBOP and BCR level of pay also needs to be upgraded from the present levels. Clear instructions in this regard is urgently needed as otherwise all Group D [both matriculate and non-matriculate] are likely to be fixed only in 1S Scale with 1300/- Grade Pay instead of PB-1 with Grade Pay 1800/= and with corresponding higher levels for TBOP/BCR.

 

3.ON PART TIME CONTINGENT

Sub: Re-fixation of remuneration of Part-time and contingent paid staff  in tune with 6th CPC revised pay – reg.

The remuneration payable to Part-time, contingent paid staff are linked with the minimum pay of the group D employees and consequent on the implementation of 6th CPC pay scale, the remuneration for the above require to be revisited and improved accordingly.

 

This Federation would therefore urge upon you to cause to issue necessary instructions to re-fix suitably the remuneration payable to these sections as early as possible.

 

 

4.ON RRR CANDIDATES

Sub: Re-fixation of wages of RRR Candidates and payment of arrears in tune with 6th CPC revised pay and allowances – reg.

 

Madam.

 

This Federation would like to seek your personal intervention in causing fixation of pay payable to RRR Candidates in tune with the implementation of revised pay structure for the respective regular employees.

 

There are more than 600 RRR Candidates in Tamilnadu Circle who are working against PA/SA, Postmen / Mailguard and Group D vacancies for the past more than 10 years on the basis of the daily wages calculated at the minimum level of respective cadre. Now the pay of these regular employees has been fixed in the 6th CPC Revised Pay Structure w.e.f. 1.1.2006. Therefore these RRR Candidates are also eligible for revised fixation at the minimum level of respective cadre since 1.1.2006 and accordingly eligible for payment of arrears also.

 

This Federation requests that suitable Directorate instruction in this matter may kindly be caused to be issued at the earliest.

 

This Federation would highly appreciate for your favourable action and a line in reply.

 

5.MERGER OF POSTAL DISPENSARIES WITH CGHS

Sub: Merger of Postal Dispensaries with CGHS – Implementation of 6th CPC Recommendations – reg.

 

Ref: 6th CPC Report Para No.7.6.16 under Department of Posts.

 

Sir,

 

Kindly refer to the above recommendations of the 6th CPC wherein it has been recommended to merge the Postal Dispensaries with that of the CGHS with a comment that there is a strong merit in the proposal made by the Department of Posts in this matter to the Ministry of Health and Family Welfare.

 

The 6th CPC has recommended that all the Dispensaries presently being run by the Department of Posts should immediately be merged with CGHS and all postal employees be covered under the CGHS Scheme, wherever available. It has also recommended that this facility should be extended to the retired postal employees.

 

This Federation therefore requests you to cause to take necessary urgent steps to get the above recommendations implemented at the earliest as such a step would help very much to get better medical treatment for the Postal Employees and Postal Pensioners in such places.

 

We will highly appreciate for favourable action and a line in reply into the nature of action taken in this matter.

 

6.PARA MEDICAL STAFF

 Sub: Para Medical Staff of Postal Dispensaries – Implementation of recommendations of 6th CPC – reg.

 

 Sir,

 

This Federation notes that certain staff like Staff Nurse have been ordered higher replacement pay scales of PB-2 with 4600/= Grade Pay in the Revised Pay Rules, 2008. There are some other Para Medical Staff for whom the recommendation is to be fixed in the corresponding Pay Scales and Grade Pay.

 

The cadres Medical Store Keepers and Laboratory Technicians have been referred in Para 7.6.10 under the Department of Posts Chapter that the Commission has considered these categories in Chapter 3.8. The recommendations made therein shall be extended to these categories as well.

 

This Federation requests for clear instructions on pay fixation for these common category of Para Medical Staff under the Department of Posts.

 

A line in reply into the nature of action will receive our high appreciation.

 

 

7.TECHNICAL POSTAL ASSISTANT

Sub: Isolated Cadre of Technical Postal Assistant in MMS – Upgradation of Scale – reg,

 

Sir,

 

This Federation notes with concern that the 6th Pay Commission has omitted totally in its report to analyse the isolated cadre of Technical Postal Assistant in MMS under the Department of Posts and would like to place the following view points for the consideration of the Department for taking up with the DOPT for appropriate grant of higher scale of pay.

 

The Technical Postal Assistant in MMS is a cadre with Diploma qualification. This cadre is to possess the minimum qualification of Diploma in Instrument Technology or Diploma in Mechanical or Electrical or Electronics Engineering from Technical Institutes recognized by the Central / State Government to be recruited for this job.

 

The 6th Pay Commission recommendation as a basic approach recommended in all cases of Diploma qualified cadres in various departments a Higher Scale of Pay in PB-2 with 4200/= Grade Pay. Unfortunately the Pay Commission was not brought into the knowledge of this cadre with Diploma qualification that led to omission of grant of higher pay to this cadre. This require to be taken up by the Department of Posts with the DOPT for grant of PB-2 with Grade Pay for Technical Postal Assistant.

 

This Federation requests that very early action in this direction may kindly be initiated.

 

8.SPECIAL DUTY ALLOWANCE TO NE REGION

Sub: Grant of Special Duty Allowance to all employees of NE Region – Implementation of 6th CPC Recommendation orders – reg.

 

 

Sir,

 

This Federation draws your kind attention to the MOF OM No.11(5)/2008-E.II(B) dated 29th August 2008 on the matter of Special (Duty) Allowance for CG Employees of NE Region (including Sikkim) and Ladakh and requests that clear instructions are required from the Directorate for effecting payment of this Allowance to all the employees of our department in the NE Region (including Sikkim) and Ladakh.

 

It is observed that the above order permits grant of this SDA to all employees by dispensing with the all India transfer liability and also says that irrespective of whether the transfer (including on initial appointment) is from outside the North Eastern Region or from another area of that region.

 

The 'Area' means any area within a sub division or a division or a revenue district or a State and therefore all the employees have been going here and there from one area to another area for working during the past so many years including their initial appointment. Therefore the SDA has to be paid to all employees working in NE Region (including Sikkim) and Ladakh hereafter without any restrictions.

 

This Federation therefore requests that the Directorate instructions for payment of SDA to all officials of these Regions may kindly be issued.

FORMAL MEETING BY MEMBER PERSONNEL

 

MEMBER [P] HELD FORMAL MEETING WITH NFPE & FNPO

 

NFPE represented by Comrades K.Ragavendran [Secretary General]; K.V.Sridharan [General Secretary P3]; Ishwar Singh Dabas [General Secretary P4] and Giriraj Singh [General Secretary R3].

 

Staff Side demand for implementation of 3ACP Scheme for Postal and that too w.e.f. 1.1.2006 has been agreed by the Department. Staff Side is to give consent for switch over to ACP from TBOP/BCR Scheme.

 

Department agreed for cadre restructuring – It is stated by the Member [P] that already the department is working on it and the Department acknowledges the  necessity to elevate the grade of Postmasters – The Staff Side is to submit detailed proposals early – Broad proposals would be again discussed with the Staff Side before acceptance by the Postal Board. Staff Side proposals will now be aimed at removing the age-old problem of denial of TBOP higher pay etc. Sorter / LDC / DEO Merger of Postal Accounts will be taken up in Cadre restructuring.

 

Our demand for separate cadre / establishment to ensure higher pay scale for System Administrators has been agreed to be processed – Staff side is to give detailed proposals to Department soon – The Department will take it up with the DOPT for approval. 

 

Staff Side demanded that the PO&RMS Accountants Special Allowance to be given the same fixation benefit like JAOs in the background of 3ACP Scheme. The Department agreed to submit the proposal again to DOPT.

 

Marketing Executives Higher Pay Scale can be taken up along with the Cadre Restructuring.

 

Anomaly of lower pay for seniors in comparison with the new recruits in the same cadre is pointed out by the Staff Side. The Department asked us to give a letter in this matter.

 

Staff Side is requested to give letters on issues like Artisans – Charge Hand – Drivers – Technical Postal Assistant in MMS – Para Medical Staff – Civil Wing PA – Post Office Treasurer and RMS Cashier disparity – etc and after considering them the anomalies will be referred to the Anomaly Committee consisting of both Official and Staff Side Members under the Scheme of JCM Departmental Council.

 

Now we go the Federal Executive Meeting in Thiruvananthapuram on 22nd September with the official view points of the Department available with us. We will finalize our proposals for Cadre Restructuring of different cadres in that meeting before discussing with the FNPO and submission of the same to the Department thereafter.

MOF ISSUES CLARIFICATORY ORDERS ON INCREMENTS & FIXATION

INCREMENT ONLY ON 1st JULY EACH YEAR

Dear Comrades! Today The MOF issued a clarificatory order on date of increment, method of fixation of pay on promotion after 1.1.2006, Use of fitment table for cases fixex under Rule 11, Fixation of pay for those on deputation etc.
 
Accordingly the date of increment will be only 1st July every year. For Officials who have been in the Revised Pay Structure for six months from 1.1.2006 to 1.7.2006 for six months are eligible for increment on 1.7.2006. It is clarified clearly that those who have drawn their earlier incerment between 2.1.2005 and 1.1.2006 would be given their next increment on 1.7.2006. Those officials whose date of increment is 1.1.2006, they would be given increment in old scale before fixation in Revised Pay and then again on 1.7.2006 another increment in the Revised Pay.
 
However this clarification is not totally satisfactory to us. The increment of those officials fallilng between 2.1.2006 and 30.06.2006 is getting postponed. The increment of other officials falling between 1.8.2006 and 31.12.2006 is getting advanced. From the Confederation it has been decided to insist for the demand already placed before the Cabinet Secretary so that all officials get their increment in Revised Pay on 1st January instead of 1st July. This will eliminate postponing of increment for some officials while preponing for some others. The Revised Charter of Demands under preparation will be exhibited in the Confederation Website shortly will contain this demand also for our 19th September 2008 programme of 'Strike Declaration Day'.
 
Another Clarification for the officials on promotion who opt for fitment in Revised Pay Structure from the date of their next increment, the clarification of MOF is that on the day of promotion the official will get the same pay in his pay band but the grade pay of his promotional level will be granted and the further re-fixation would be done on the day of his new increment viz, 1st July when he would get two increments - one annual increment and the other the promotional increment. 
 
There are other clarifications also about officials who opt for revised pay from the date of their promotion; Fitment under Rule 11 of CCS[RP]Rules 2008, Fixation for officials on deputation, Procedure to be adopted for placing the officials in cases of merger of scales / upgradations recommended by the 6th CPC.
 
As for as the merger of scales / upgradations are concerned, it is clarified that in cases where all posts in one cade or more in pre-revised scales are merged with a higher pre-revised scale of pay the officials would be granted the replacement pay scale/Grade Pay. In cases where all posts in  particular cadre have been granted a higher replacement scale then the officials would be fixed in their pre-revised pay scale with the Grade Pay of the higher replacement scale.

DATE OF NEXT INCREMENT – 1.7.2006 OR 1.7.2007?

WHEN WILL BE THE DATE OF NEXT INCREMENT
 
Whether 1.7.2006 OR 1.7.2007?

 

SOME DDOs WRONGLY DO NOT DRAW INCREMENT ON 1.7.2006
 
Annual Increment should be drawn on 1.7.2006 if the official's pay fixed in Revised Pay Structure on 1.1.2006 as per Para 10 of CCS [RP] Rules, 2008.

 

Dear Comrades,

 

Majority of DDOs correctly apply the Para 10 of the CCS [RP] Rules, 2008 and draw increment in revised pay on 1.7.2006 for all those employees those who have been placed in the Revised 6th CPC Pay Structure w.e.f. 1.1.2006 by virtue of their remaining under the Revised Pay Structure for 6 months.
 
However, there are reports that some DDOs are not doing so and not drawing the annual increment on 1.7.2006 but only drawing it on 1.7.2007 for those employees whose existing date of increment is between 1st January 2006 and 1st June 2006. This is wrong.

 

Kindly refer to CCS [RP] Rules, 2008 under Para Numbered 10 on 'Date of next increment in the revised pay structure' – wherein it is stipulated that:

 

"There will be a uniform date of annual increment. Viz, 1st July of every year. Employees completing 6 months and above in the revised pay structure as on 1st of July will be eligible to be granted the increment. The first increment after fixation of pay on 1.1.2006 in the revised pay structure will be granted on 1.7.2006 for those employees for whom the date of next increment was between 1st July, 2006 to 1st January, 2007."  

 

The above Para 10 has got three parts.
 
1. There will be a uniform date of annual increment viz, 1st July of every year.
2. Exployees completing 6 months and above in the revised pay structure as on 1st July will be eligible to be granted the increment.
3. The first increment after fixation of pay on 1.1.2006 in the revised pay structure will be granted on 1.7.2006 for those employees [also] for whom the date of next increment was between 1st July 2006 to 1st January 2007.
 
[Note: The bracketed word "also" is not in original orders but to make the meaning clear i have put it there for your understanding]
 
 
NOW LET US ANALYSE THE WHOLE PARA:
 
Employees completing 6 months and above in the revised pay structure as on 1st of July will be eligible to be granted the increment – This means that all employees who were placed in the revised pay structure on 1.1.2006 and will be completing 6 months service in the revised pay structure as on 1st July 2006 are eligible for an increment on 1.7.2006.

 

BASED ON THIS LINE OF THE ORDER ALL EMPLOYEES ARE ELIGIBLE TO GET NEXT INCREMENT ON 1.7.2006 IN THE REVISED PAY.

 

The next sentence of the Para 10 viz," The first increment after fixation of pay on 1.1.2006 in the revised pay structure will be granted on 1.7.2006 for those employees for whom the date of next increment was between 1st July, 2006 to 1st January, 2007." – means those employees whose increment date is on or after 1st July also should be given the increment from 1.7.2006 itself.

 

Therefore the first line of Para 10 of the Government Order which says "There will be a uniform date of annual increment. Viz, 1st July of every year" will be thus correctly implemented if the increment is drawn to officials whose increment date presently on or after 1st July 2006 and also before 1st July 2006 provided the official's pay is fixed in Revised Pay Structure from 1.1.2006. The main point is that without being in the Revised Pay Struture no official can draw his new increment in the Revised pay structure. This is the main contention of the order.

 

There are some DDOs who are confused with linking the two sentences in Para 10 and refusing to grant the increment on 1.7.2006 but giving increment only on 1.7.2007 for those employees whose increment falls between 1st January to 1st June of 2006, thus causing postponement of grant of increment beyond 2 years. This is wrong.  This will in effect even deny the benefit of increment for officials who are about to retire before 1.7.2007 and cause heavy pension loss too. More over this is not the intention of the order also. Only a wrong understanding of the Para 10 by these DDOs causes such a problem. Please approach these DDOs with this interpretation and cause correct application.

19.09.2008 – Strike Declaration Day

 

 * PROTEST STRONGLY ON 19TH SEPTEMBER 2008.

Dear Comrades!

 

Remember that we have to observe with all vigour and urgency the Strike Declaration Day on 19th September 2008.

 

Confederation National Executive has given this call in preparation for highlighting the 18 Point Charter of Demands to launch the nationwide campaign that should culminate in Strike Ballot and Indefinite Strike.

 

NFPE has given the call to launch the demonstration with special emphasis on 'Enhancement of Bonus Ceiling for all CG Employees' to 3500/= as per the amended Bonus Act.

 

NFPE also calls upon you to effectively focus the other demand in the Charter for 'Immediate Submission GDS Committee Report with grant of Status and Pension'. The Nataraja Murti Committee is delaying submission of its Report and this may cause some serious problems for us if elections are declared. Urgency is there to get the Report early.

 

We also remind our comrades that unless the Minimum Wage is improved on par with 15th ILC Norms we will be forced to bear heavy loss in future as there is not going to be any merger of DA in future.

 

Honourable President of India – Vice President of India – Governors have been offered a 300% rise in pay by Union Cabinet. We are happy that they are our Constitutional Heads and Dignitaries.

 

6th Pay Commission has provided for a maximum of 180% fitment benefit for Group A Officers. We are not unhappy over it. Let them enjoy the hike.

 

But the Pay Commission cheated the Group C and D employees to the maximum and Group B to certain extent. Not even the minimum rise of 41% ensured to the Group A Officers is extended to others. This is gross injustice. This is intolerable.

 

The Union Cabinet has come forward to improve the Grade Pay of Group A Officers beyond the recommendations of the Pay Commission. But no attempt to address the genuine grievances of Group C and D employees in their Pay Bands. The existing hierarchical benefit in ACP Scheme  is  taken away on one hand but Group A Officers who are hitherto not covered by ACP Scheme are also extended the additional benefit of 3 ACP Scheme.

 

The Transport Allowance of a Group A Officer is 7000/= per month. The minimum pay of a Group C is also 7000/= per month. Petrol charges of an Officer's car are equated with the total expenditure of a Group C family at the bottom. But the Cabinet refused to consider the Staff Side demand for rationalization of Transport Allowance to ensure minimum 1200/= in metro and 800/= in non-metros as Transport Allowance to lower grade employees.

A Naked Attack on the interests of Group D employees through plans to outsourcing!
