GOVT. ORDER ON PENSION FIXATION FOR OFFICIALS DIED WITHOUT JOINING DUTY AFTER 1.1.2006


GOVERNMENT ORDER RELEASED ON REGULATION OF PENSION AND OTHER RETIREMENT BENEFITS IN CASE OF OFFICIALS WHO WERE ON EOL / SUSPENSION / UNAUTHORIZED ABSENCE AS ON 1.1.2006 AND DIED SUBSEQUENTLY WITHOUT JOINING DUTY


For Such Officials who were on suspension or unauthorizedly absent or on EOL but died before joining duty after 1.1.2006, Department of Pension ordered that their actual Pay and Allowancesemoluments just prior to their EOL or Suspension etc would be taken into account under Rule 33 of the CCS [Pension] Rules and FR 9 (21) (a) (i).
It is further ordered that such Pension or Family Pension so calculated would be further refixed as per the Department of Pension and Pensioners Welfare OM No. dated 1.9.2008 and would be paid from the date it is due to be paid. For the purpose of Gratuity, the Dearness Allowance on the day of death / retirement would be admissible. The Pension/Family Pension/Commutation of Pension/Gratuity will be regulated as per the Rules applicable before 1.1.2006.
