NFPE SERVED LETTER OF ULTIMATUM TO DEPARTMENT ON POSTAL CHARTER OF DEMANDS ALSO

Dear Comrades!
 
This day morning a letter signed by all General Secretaries of NFPE affiliated unions / associations and the Secretary General intimating total solidarity to GDS Indefinite Strike has been served on the Secretary Department of Posts, intimating that all the Postal Employees will embark upon the indefinite strike w.e.f. 17.12.2008. The copy of the letter dated 9.12.2008 addressed to Secretary [P]  was already exhibited in the website yesterday but one line is added at the end of the letter as follows: " This letter may please be treated as Strike Notice". The full text of the corrected letter is also reproduced below.
 
Accordingly all Postal, RMS, MMS, Administrative and Postal Accounts will be on indefinite strike from 17.12.2008 if the negotiations are not held to settle the demands of the Staff Side on modifications of Nataraja Murti Committee recommendations.
 
Another letter of ultimatum by the Federation also is submitted to the Secretary Department of Posts today morning with the Charter of Demands containing all GDS and Regular Postal Employees issues as per the decision of the Guntur All India Convention of NFPE Unions / Associations. The entire text of letter and the updated Charter of Demands also are reproduced below. We have requested immediate negotiations and settlement of all these demands before 18.12.2008 and intimated that as per the decision of the All India Convention a Strike Notice for indefinite strike during first week of January 2009 would be served on 19.12.2008.

Sub: Request for negotiations with the Staff Side for effecting modifications in the GDS Committee Report – Resolution of the NFPE Federal Secretariat - reg.

 

Sir,

 

The Federal Secretariat of NFPE that met on 9.12.2008 has considered the submitted report of Nataraja Murti Committee and the constitution of a Senior Officers Committee for considering the implementation thereof. It has also considered the Note submitted by the NFPE as well as by the different GDS Unions / Federations seeking modification in the report. The fact that no discussion over the modifications requested by the staff side is forthcoming is also engaged the attention of the Federal Secretariat.

 

The All India Postal Extra Departmental Employees Union has served a Notice for Indefinite Strike from 17.12.2008. In this background the Federal Secretariat after a thorough discussion on 9.12.2008 has resolved to request the Postal Board to commence meaningful negotiations with the Staff Side to modify the Nataraja Murti Committee recommendations and settle the demands to avert the Indefinite Strike for preservation of tranquillity and peace in the services.

 

The resolution adopted in the Federal Secretariat requesting negotiations and also expressing solidarity by the regular employees to the strike action of GDS is enclosed for favour of your kind information and necessary action. This letter may please be treated as Strike Notice.

RESOLUTION ADOPTED UNANIMOUSLY IN THE FEDERAL SECRETARIAT MEETING HELD ON 09.12.2008.

 

 

The Federal Secretariat of NFPE which met at the office of the NFPE on the afternoon of 9.12.2008 on analysing the entire development of events taken place including the situation arising out of submission of Indefinite Strike notice by the GDS Union, has unanimously resolved to call upon the entirety of postal regular employees to extend total solidarity to the striking GDS by joining the Indefinite Strike from 17.12.2008 and make the strike programme of GDS a grand success. 

 

This Secretariat also resolves unanimously to call upon the Postal Board to hold meaningful negotiations immediately with the Staff Side and reject the negative recommendations of the GDS Committee as well as to modify them as demanded by the unions / federations and avert the Indefinite Strike in the larger interest of three lakhs of Gramin Dak Sewaks and also to protect tranquillity and peace in Department of Posts.

Sub: Request for discussion and settlement of vital issues of Postal Employees – Decision of All India Convention of NFPE Unions – reg.

 

Sir,

 

This Federation is constrained to bring to your kind notice that the All India Convention of all Circle Secretaries and CHQ Office Bearers of all affiliates of this Federation held at Guntur on 29.11.2008 has resolved to submit the enclosed Charter of Demands to the Department for settlement and to launch an Indefinite Strike in the event of non-negotiated settlement.

 

It can be seen that almost all the demands were taken up with the department for long. Many issues were submitted to the department through unions wise Charter of Demands in the month of February 2008 [15.02.2008]. Unfortunately no attempt to convene any meaningful negotiation with the Staff Side is forthcoming causing grave concern and disillusion amongst the entirety of postal employees.

 

It is in this background that the All India Convention of NFPE unions and associations took the decision to submit the enclosed Charter of Demands and request for a negotiated settlement. It is also decided by the above all India Convention that in the event of a non-negotiation by the department for a negotiated settlement before 18th December 2008, the entire postal employees shall have to embark on an Indefinite Strike in the first week of January for which a formal Notice shall have to be served on 19th December 2008.

 

This Federation is confident that you will personally intervene in this matter and cause serious discussions with the Staff Side on the long pending vital issues of the employees' to restore peace in the minds of the employees and to avert any unpleasant development that may disturb the tranquillity in our services.

 

We therefore request for your kind and immediate action that may be appropriate to bring about a negotiated settlement.

CHARTER OF DEMANDS

 

  1. Modify and improve the recommendations of Nataraja Murti Committee and reject the retrograde recommendations [list of modifications / rejections endorsed separately].
  2. Re-fix the wages all Paid Substitutes – RRR Candidates – Part Time / Contingent w.e.f. 1.1.2006 on the basis of 6th CPC Revised Pay Scales.
  3. Exempt Postal Department from the purview of Screening Committee and fill up all vacant posts in all cadres immediately.
  4. Hold Periodical Meeting and JCM Departmental Council / RJCM Regional Council meetings as per the schedule.
  5. Implement all issues of April 2007 Strike Settlement.
  6. Negotiate and settle the sectional charter of demands submitted by Federations and unions on 15.02.2008.
  7. Finalise Cadre Review for all cadres – creation of a separate establishment for System Administrators and redressing their current problems.
  8. Improve the ACP and make it applicable to Postal Employees.
  9. Remove all trade union victimisation in all Circles and end irrational application of Contributory Negligence orders.
  10. Do not introduce new schemes without consultations with the Staff Side.
  11. Withdraw the SLP against the RRR Candidates and absorb them immediately.
  12. Grant immediate fixation of higher scale as per 6th CPC to TBOP/BCR Postmen / Mailguards.
  13. Grant higher pay scales to Head Mail Peons at par with Postman / Mailguard.
  14. Grant Notional fixation for Artisan Grade I in MMS w.e.f. 1.1.1996 at par with the Railways and Defence.
  15. Redistribute the LSG / HSG II / HSG I posts for Circle Offices including DPLI Kolkata.
  16. Withdraw decentralisation of PLI/RPLI functions of Circle Offices.
  17. Stipulate periodicity of deputationists to Circle Offices and recruit new incumbents.
  18. Ensure integration of all Accounting streams in DOP under PA Wing and stop the proposed move to decentralise Postal Accounts.
  19. Restore the 3 year periodicity for promotion to Senior Accountant cadre.

    What about 14 days mandatory period for serving a strike notice.? From 09.12.08 to 16.12.08 is only 08 days. Is it not? Kindly clarify.

  2. Dear Comrade Kanivel - NFPE strived for a joint struggle from 6.1.2009 on a Postal Charter of Demands including GDS. But ignoring the NFPE decision for a well planned and organised joint strike, the GDS Union has served the strike notice on 2nd December 2008 with fourteen days notice for starting the strike on 17.12.2008. We do not have time for doing so but we have our responsibility to three lakhs of GDS. How can we be mere spectators when GDS go on strike? So technicalities apart we have to stand by them. This is the basic reason of the decision of the Federal Secretariat. I hope you would understand and appreciate our position. Regards

  3. The 7th item of the charter of demands says "Finalise Cadre Review for all cadres – creation of a separate establishment for System Administrators and redressing their current problems."

    The cadre review of all is okay. But creation of a separate establishment for SAs will only reduce the PA strenth and designate it as SA for identified places. This will not solve the problems of SAs or fetch any benefits to SAs. If the demand is for a separate CADRE instead of seperate establishment for SAs it would have solved either. Once a Cadre is established defenitely there will be establishment. Now it will be like Accountants.

    This demand will not only irk the SAs of Department of Posts but their participation in the strike need to be reviewed. Because this is not meeting SAs demand. It is only a gimmick.

When country is struggling for maintain it internal security, when all parties are standing unitedly to support Govt. during this crucial stage, Employees of DoP is serving indefinite strike notice without observing stipulated period for that also! It's really horrible. No one will give moral support for this irresponsible ' industrial action'.

  5. Dear Comrade Anjali - Your patriotic sentiments are well appreciated. We are hundred percent behind the Government for all steps against terrorism. But that does not mean we should keep quiet and accept great injustice contemplated on the exploited three lakhs of GDS by the Nataraja Murti Committee. We have our responsibility as citizens but we also have responsibility as trade unionists to defend the exploited lot.
